01Scope of Services
D'Alvia Moving LLC provides residential and commercial moving services in McDonough, Georgia, and the greater Atlanta metropolitan area. Our services may include loading, transportation, unloading, packing, unpacking, furniture protection, furniture disassembly and reassembly, and short-term storage arrangements when separately agreed.
The specific services to be performed for your move will be described in your written quote, work order, and/or Bill of Lading. Any service not expressly listed is not part of our agreement unless we agree in writing.
02Quotes and Estimates
We provide quotes based on the information you give us — including inventory, home or office size, distance, access conditions (stairs, elevators, parking), special items, and requested services. Quotes are estimates and not guaranteed final prices unless specifically labeled as a "Binding Estimate" or "Flat Rate."
If the actual conditions on move day differ materially from what you described — for example, additional items, longer carrying distances, additional flights of stairs, blocked access, or services you add — the final price may be adjusted accordingly. We will notify you of any anticipated change before performing the additional work whenever possible.
Validity Period
Quotes are valid for thirty (30) days from the date issued unless otherwise stated. After expiration, pricing and availability may change.
03Booking and Deposits
To reserve a move date, we may require a deposit. The deposit amount and any payment instructions will be communicated in your written confirmation. Your move date is not secured until the deposit is received and confirmed.
Deposits are credited toward your final balance and are subject to the cancellation terms in Section 5.
04Pricing and Payment
Our pricing is typically based on an hourly rate (for local moves), a flat rate, or a binding/non-binding written estimate, depending on the service. Hourly rates begin when our crew arrives at the origin location and end when unloading is complete at the destination, unless otherwise stated in your quote.
Accepted Payment Methods
We accept major credit and debit cards, ACH bank transfers, and other electronic payment methods as offered. Cash payments may be accepted at our discretion. All card payments are processed through our payment processor (Stripe, Inc.) — we do not store full card numbers ourselves.
When Payment Is Due
Full payment is due upon completion of the move, before the crew leaves the destination, unless other arrangements have been agreed in writing in advance. For commercial accounts, invoices may be issued net 15 or net 30 by written agreement only.
Late Payments
Past due balances may be subject to a late fee of 1.5% per month (or the maximum allowed under Georgia law, whichever is lower) and may be referred to collections. Customer agrees to pay reasonable costs of collection, including attorney's fees, if applicable.
05Cancellation and Rescheduling
Plans change — we understand. Our cancellation policy is designed to be fair to both Customer and our crew, whose schedule is reserved when you book.
- More than 48 hours before scheduled start: Full deposit refund, or one free reschedule to a future date within 90 days.
- Within 48 hours of scheduled start: Deposit is non-refundable but may be applied to a rescheduled move within 30 days, subject to availability.
- Same-day cancellation or no-show: Deposit is forfeited, and a minimum service fee equal to the crew's scheduled minimum (typically 2-3 hours at the hourly rate) may be charged.
If D'Alvia Moving must cancel or reschedule due to events beyond our reasonable control (see Section 10), we will work with you in good faith to reschedule and will refund any prepaid amounts not used.
06Customer Responsibilities
For your move to go smoothly, we ask that you:
- Provide accurate inventory and address information at booking
- Be present (or designate an authorized adult representative) at both origin and destination during the move
- Ensure clear access to entrances, hallways, stairs, elevators, and parking
- Notify us in advance of any special handling items, large or unusual furniture, fragile items, or pets on site
- Pack personal items, important documents, jewelry, cash, and valuables yourself unless you have engaged our packing service
- Provide accurate utility, parking, building, or HOA information that may affect access
If inaccurate information or undisclosed conditions cause delays, additional crew time, or special equipment, those costs may be billed in addition to your quote.
07Items We Will Not Move
For safety, legal, and insurance reasons, our crews will not transport the following:
- Hazardous, flammable, or explosive materials (gasoline, propane, paint thinners, fireworks, ammunition, etc.)
- Live animals or pets
- Perishable food, plants that may not survive transit, or open containers of liquids
- Illegal substances or items obtained illegally
- Cash, coins, jewelry, precious metals, securities, or other high-value items that should be transported by Customer personally
- Important original documents (passports, birth certificates, wills, deeds) — please carry these yourself
- Loaded firearms (unloaded firearms only when properly disclosed in advance and packaged per federal and state law)
If prohibited items are discovered during loading or transit, we may decline to move them, return them to the origin, or contact appropriate authorities, depending on the item.
08Valuation and Liability for Loss or Damage
Important: Moving valuation is not the same as full-value insurance. Please read this section carefully and ask us any questions before your move.
Default Released Value Liability
Unless you select a higher valuation option in writing, D'Alvia Moving's liability for loss or damage to your goods is limited to the minimum released value of $0.60 per pound per article. This is a federal industry default rate adopted for our intrastate moves. For example, if a 50-pound item is damaged or lost, our maximum liability under released value would be $30.00 — regardless of the item's actual replacement cost.
Optional Higher Valuation Coverage
You may purchase higher valuation coverage at additional cost, declared in writing before the move begins. We will explain available options and pricing during the quote process. Higher valuation coverage is strongly recommended for moves containing high-value items.
Items of Extraordinary Value
Articles with a value greater than $100 per pound (such as jewelry, antiques, fine art, collectibles, and electronics) must be declared in writing before the move. Undeclared items of extraordinary value are subject to the same per-pound liability limit regardless of actual value.
Items Excluded from Liability
D'Alvia Moving is not responsible for damage to:
- Items packed by Customer ("PBO" — Packed By Owner) — unless the damage is clearly the result of mishandling during transport
- Particleboard, pressed-wood, or ready-to-assemble furniture (which can fail from normal moving stress)
- Mechanical or electronic function of appliances, electronics, or instruments (we are responsible for visible physical damage, not internal mechanical failure)
- Items left inside drawers, on shelves, or in unpacked furniture
- Pre-existing damage noted on the inventory or Bill of Lading
- Normal wear and tear from a properly performed move
09Claims Process
If you believe an item was lost or damaged during your move, we want the opportunity to make it right.
Notice Requirements
- Visible damage should be noted on the Bill of Lading or inventory sheet at the time of delivery, before the crew leaves the destination.
- Concealed damage or loss must be reported to D'Alvia Moving in writing as soon as reasonably possible, and no later than nine (9) months from the date of delivery.
Send written claims to support@dalviamoving.com with a clear description of the item, the nature of the damage or loss, the move date, photos when available, and any supporting documentation.
Claim Resolution
We will acknowledge your claim within thirty (30) days of receipt and provide a written resolution within one hundred twenty (120) days. Resolution may include repair, replacement, or payment up to the applicable valuation limit. Customer agrees to allow D'Alvia Moving a reasonable opportunity to inspect damaged items before disposing of them.
10Delays and Force Majeure
We make every effort to arrive and complete your move on schedule. However, we are not liable for delays or non-performance caused by events beyond our reasonable control, including but not limited to: severe weather, road closures, traffic accidents, mechanical breakdown of equipment despite reasonable maintenance, acts of government or authorities, civil unrest, fire, flood, pandemic, or other acts of God.
In the event of such delay, we will notify you as soon as practical and work with you in good faith to reschedule or complete the move.
11Insurance
D'Alvia Moving LLC maintains general liability insurance and cargo coverage as required by applicable law and industry standards. Proof of insurance is available on written request. The existence of insurance does not expand the contractual liability limits described in Section 8.
12Communications and Privacy
By providing your contact information and engaging our services, you authorize us to communicate with you about your quote, booking, move-day logistics, invoices, and follow-up — by phone, text message (SMS), and email.
Our handling of your personal information, including SMS consent and opt-out procedures, is described in our Privacy Policy. By agreeing to these Terms, you also acknowledge our Privacy Policy.
13Dispute Resolution and Governing Law
These Terms and any agreement between Customer and D'Alvia Moving LLC are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles.
Informal Resolution First
Before initiating any formal legal action, both parties agree to attempt in good faith to resolve any dispute by direct communication. Customer agrees to contact support@dalviamoving.com and describe the dispute, allowing D'Alvia Moving a reasonable opportunity (at least thirty days) to investigate and respond.
Venue
Any dispute that cannot be resolved informally and that proceeds to formal action shall be brought exclusively in the state or federal courts located in Henry County, Georgia, and both parties consent to the personal jurisdiction of those courts.
14Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our practices, services, or legal requirements. The current version will always be available on our website with an updated "Last Updated" date. For active bookings, the Terms in effect at the time you confirmed your booking will continue to apply unless we agree otherwise in writing.
